Settlement of Disputes

Article 15

Should either Party fail to comply with its obligations under this Agreement, the other Party shall have the right to terminate this Agreement by providing one month's written notice.

Each Party shall maintain in its respective territory comprehensive competition laws which effectively address anti competitive agreements, concerted practices and anti competitive unilateral conduct of undertakings with dominant market power and provide effective control of concentrations.

In order to ensure the proper application of this Protocol, the Community and Bosnia and Herzegovina shall assist each other, through the competent customs administrations, in checking the authenticity of the movement certificates EUR.1 or the invoice declarations and the correctness of the information given in these documents.

For the purpose of implementing this Agreement, Appendix I and the relevant provisions of Appendix II to the Regional Convention on pan Euro Mediterranean preferential rules of origin 1 ( the Convention ) shall apply.

Article 31

The Parties recognise that full and productive employment and decent work for all are key elements of sustainable development for all countries and a priority objective of international cooperation.

Article 37

The settlement of disputes between Parties concerning the interpretation or application of this Protocol is governed by Article 27 of the WHO Framework Convention on Tobacco Control.

Parties agree that

the Convention Secretariat shall advise developing country Parties and Parties with economies in transition, upon request, on available sources of funding to facilitate implementation of their obligations under this Protocol.

The working languages of the Foundation shall be those used by the strategic partnership between Latin America and the Caribbean and the European Union since its establishment in June 1999.

The Parties shall refer disputes on the interpretation or application of this Agreement arising between them to the Joint Committee for resolution.

The Joint Committee shall meet once a year, in the Union and Chile alternately, on a mutually agreed date.

Article 286

Any information communicated under this Chapter shall be treated by the receiving Party as confidential unless the other Party, in accordance with its domestic law, has authorised the disclosure or made that information available to the general public.

Dispute settlement

The Parties shall take any general or specific actions required to fulfil their obligations under this Agreement, based on the principles of mutual respect, equal partnership and respect for international law.
