The Evaluator shall notify the JIC of all received complaints and the actions taken to resolve them.

The EU shall forthwith notify the Seychelles of any changes in its Common Fisheries Policy or legislation.

Such information shall not be communicated to persons other than those within the Community institutions, in the Member States, or in Switzerland whose functions require them to know it, nor may it be used for purposes other than to ensure effective protection of the financial interests of the Contracting Parties.

Article 6.10

GENERAL PROVISIONS

The activities of Union vessels in Mauritius waters are subject to the laws and regulations of Mauritius unless otherwise provided under this Protocol and its Annex.

Settlement of disputes

Information communicated or acquired in any form whatsoever pursuant to this Annex will be covered by professional confidentiality and protected in the same way as similar information is protected by the national legislation of Switzerland and by the corresponding provisions applicable to the Community institutions.

For the purposes of proper implementation of this Annex, the competent Swiss and Community authorities shall exchange information regularly and, at the request of one of the Parties, shall conduct consultations.

Each year, the Commission may use up to EUR 181424 of the payments made by Switzerland to finance the administrative expenditure related to staff or external staff necessary for supporting the implementation by Switzerland of Regulation (EU) No 515 2014 and this Agreement.

On The Spot Checks by OLAF

Where the participants in Programmes covered by this Agreement and activities carried out by Fusion for Energy resist an on the spot check or inspection, the Swiss authorities, acting in accordance with national rules, shall give OLAF investigators such assistance as they need to allow them to discharge their duty in carrying out an on the spot check or inspection.

Within the framework of this Agreement, the Commission (OLAF) shall be authorised to carry out on the spot checks and inspections in the premises of participants and their subcontractors from the Faroes, in accordance with the terms and conditions laid down in Council Regulation (Euratom, EC) No 2185 96 1 .

The consolidating division of the Tribunal shall grant such order where it is satisfied that the conditions of paragraph 8 are met and that granting such a request would not unduly burden or unfairly prejudice the disputing parties or unduly disrupt the proceedings.

Such obligations will not be regarded as anti competitive per se, provided they are administered in a transparent, objective and non discriminatory way.

The Parties shall carry out exploratory fishing in line with the conditions laid down by the Joint Scientific Working Group.

Article 12

All activities of European Union fishing vessels in the Malagasy fishing zone shall be suspended for the duration of the period of suspension.

Termination

Such data shall be used exclusively for the purposes of implementing the Agreement.

Unless otherwise decided, the Trade Committee shall normally base its deliberations on documentation and proposals prepared in the languages referred to in paragraph 1.
